Terms and Conditions
Applicable Law – Michigan Compiled Laws [MCL] are controlling for this agreement. That a residential builder or a residential maintenance and alteration contractor is required to be licensed under article 24 of the occupational code, 1980 PA 299, MCL 339.2401 to 339.2412. That a mechanical contractor is required to be licensed under the Skilled Trades Regulation Act, 2016 PA 407, MCL 339.5101 to 339.6133. If the contractor is required to be licensed to provide the contracted improvement, that the contractor is licensed and the contractor’s license numbers are:
Mechanical Contractor License – No. 71-17582 with the following categories:
- Class 1: Heating & Cooling and Process Piping
- Class 2 – HVAC Equipment
- Class 3 – Ductwork
- Class 5 – Limited Heating Service
Plumbing License – No. 81-09440
Boiler Installer’s License – No. 316109-2B
Contractor License – No. 80-03108
In Home Solicitation Notice of Cancellation
You may cancel an eligible in-home solicitation sales transaction, without any penalty or obligation, within three (3) business days from the date of acceptance. If you cancel, Godwin Plumbing Inc., doing business as Godwin Heating and Cooling, will return within ten (10) business days following receipt of your cancellation notice, any payments(s) made by you under this contract or sale, and any negotiable instrument executed by you and any security interest arising out of this transaction will be canceled. If you cancel, you must make available to the seller at your residence, in substantially as good condition as when received, any goods delivered to you under this contract or sale. If you do make the goods available to the seller and the seller does not pick them up within twenty (20) days of the date of your notice of cancellation, you may retain or dispose of the goods without any further obligation. If you fail to make the goods available to the seller, then you remain liable for performance of all obligations under this contract or sale. To cancel an in-home solicitation sales transaction, mail or deliver a signed and dated copy of this cancellation notice or other signed and dated written notice of cancellation to Godwin Plumbing Inc., doing business as Godwin Heating and Cooling, at 3703 S. Division Ave. – Grand Rapids, MI 49548, no later than midnight of the third (3rd) business day from the date of acceptance.
All moneys, not paid according to the stated payment terms are subject to interest at twenty percent (20%) annual percentage rate (APR) and any cost incurred in collection thereof, including actual attorney fees.
Request for Notice of Commencement
This is a formal request for a copy of the Notice of Commencement pursuant to MCL 570.1108 or for the information required (property’s legal description, name and addresses of all owners of the property) so as to be able to provide a Notice of Furnishing to the property owner(s) in the event that all property owner(s) do not authorize the work proposed.
Warranties and Guarantees
Any of Godwin Plumbing Inc.’s, doing business as Godwin Heating and Cooling, warranty and guarantee agreements are contingent on payment in full being received, proper use of equipment and system. All of Godwin Plumbing Inc.’s, doing business as Godwin Heating and Cooling, warranty and guarantee agreements only provide coverage for the cost of providing such service during normal business hours. If after hours warranty work is requested, an additional charge is due for the difference between normal and overtime. The time period for warranty on equipment or a system begins when it is first used, regardless of when the project is completed or billed final. All warranties and guarantees are limited solely to what is exactly stated in writing; there is no implied warranty or guarantee of any type other than that what is specifically required by Michigan law. The entity or person(s) authorizing the work, their successors and assignees agrees that Godwin Plumbing Inc., doing business as Godwin Heating and Cooling, is not responsible for any type of known or unknown incidental or consequential damages, unless specifically required by Michigan law.
All work is to be completed in a workmanlike manner in accordance with generally accepted and or customary mechanical practices. Any alteration or deviation (including any modification to an existing system required by code, law or others) involving additional cost from the listed specifications shall become a valid extra charge over and above the accepted price and due in accordance to the same payment terms and conditions. This agreement is contingent upon strikes, accidents, and or a delay beyond Godwin Plumbing Inc.’s, doing business as Godwin Heating and Cooling, control. The entity or person(s) authorizing the work is carrying and will carry through the completion of the accepted work, proper and adequate theft, fire, tornado, flood and other necessary insurance to cover the value of the work installed until full payment is made. Sections of these terms and conditions shall be deemed severable. If any part of this is declared by a court of competent jurisdiction to be invalid or unenforceable, such decision shall not affect the validity of the whole or any part thereof, other than the part so declared invalid or unenforceable. Modifications to these terms and conditions are only valid if they are in writing and signed by the president of Godwin Plumbing Inc., doing business as Godwin Heating and Cooling.
